Healthcare Lien Defined

A healthcare lien is a claim that a healthcare entity makes against your client’s personal injury settlement to ensure that they receive payment for the services they’ve provided. When a client is injured by another party, that party is responsible for payment of your medical bills. Oftentimes, that payment is sought via litigation. In the meantime, a client’s health insurer will pay medical expenses. However, they have the right to pursue a claim once a settlement has been reached with the third party.

Health Insurance Providers

Health insurance providers can apply a lien against your client to recover funds used to pay their medical costs.

Hospitals

Hospitals may apply a lien to recover medical expenses so long as they follow statutes governing this process. Certain medical providers may request that patients sign a letter authorizing that a lien may be applied against your client’s settlement.

Medicare Part A and B

According to federal law, if Medicare pays for medical treatment for an injury related to a settlement, they have the first right to apply a lien to the settlement.
